Terms & Conditions of Sale and Use

1. Who we are

This website (the “Site”) is operated by The Real Corp Dxb LLC, a New-Mexico limited-liability company, EIN 93-2949689, registered office 2201 Menaul Blvd NE Ste A, Albuquerque, NM 87107, USA.

Throughout these Terms, “we”, “our” or “Vendor” refers to The Real Corp Dxb LLC; “Payment Processor” refers to Starlight E-commerce & Consulting LLC; “you” or “Customer” refers to any person placing an order on the Site.

2. Scope of these Terms

These Terms govern every purchase of goods or digital services made via the Site. By accessing, browsing or purchasing, you confirm that you have read and agree to be bound by them and by our Privacy Policy.

3. Products & availability

Product descriptions, prices, promotions and stock levels may change without notice. We reserve the right to limit quantities or discontinue any product at any time.

3-A. Territory & shipping scope

We currently sell and ship only to addresses within the United States.
Orders from outside the U.S. will be cancelled and refunded.

3-B. International duties & customs

For shipments outside the United States, you are the importer-of-record and are responsible for all customs duties, VAT/GST, brokerage fees and other charges levied by the destination country.

4. Prices, currency & taxes

All prices are listed in U.S. dollars (USD) unless stated otherwise. If your payment provider uses another currency, conversion and any FX fees are set by that provider. Applicable U.S. sales tax (or other local tax) is calculated at checkout based on the shipping address.

4-A. California Proposition 65 warning

Some products may expose you to chemicals known to the State of California to cause cancer, birth defects or other reproductive harm. For more information visit www.P65Warnings.ca.gov.

5. Payment methods

Card data are transmitted directly to Stripe’s PCI-DSS compliant servers; we never store full card details.

6. Order process & contract formation

1. You add items to the cart and complete checkout.
2. You receive an automated email acknowledging receipt (not yet acceptance).
3. A shipping-confirmation email signifies our acceptance and forms the contract.
   We may refuse or cancel an order if payment cannot be captured, fraud is suspected, or stock is unavailable.

7. Shipping & delivery

Unless a faster option is chosen, orders ship within 2 business days via a tracked service. Estimated transit times shown at checkout are non-binding. Title and risk pass on delivery.

8. Right of withdrawal & returns

Consumers residing in the EEA/UK may cancel within 14 days of delivery; business buyers are excluded. Email support@vallancia.com  before the deadline. Return goods in re-saleable condition at your cost; we refund (excluding outbound shipping) within 7 business days of receipt.

9. Warranties & liability

Goods are warranted against manufacturing defects for 12 months. Our total liability is limited to the price paid. We are not liable for indirect or consequential losses unless mandatory law provides otherwise.

10. Intellectual property

All Site content is owned or licensed by us and protected by U.S. and international law. You may not reproduce or exploit it without prior written consent.

11. Data protection

Personal data are processed under our Privacy Policy and, where applicable, the EU GDPR and US Federal Decree-Law 45 of 2021.

12. Informal dispute resolution & arbitration (class-action waiver)

Before filing a claim, you agree to email support@vallancia.com and allow us 30 days to resolve the issue informally.
If unresolved, any claim or dispute arising out of these Terms or a purchase shall be submitted to binding arbitration under JAMS Consumer Arbitration Rules. You and we waive any right to participate in a class action or class arbitration. Each party bears its own costs; the arbitrator may award fees under applicable law. The arbitration will take place in Albuquerque, New Mexico, unless you choose teleconference or document-only proceedings. Judgment on any award may be entered in any court of competent jurisdiction.

13. Age & restricted-use statement

The Site is intended for individuals 18 years or older. We do not knowingly sell to minors. We sell only non-regulated consumer goods; items requiring legal age verification are not offered.

14. Governing law & jurisdiction

These Terms are governed by New Mexico and U.S. federal law. Courts in Albuquerque, NM, have exclusive jurisdiction, except consumers in the EEA may use the EU ODR platform.
